(Halden Arbeiderblad): Four times a year, an inspection report is written to the Control Committee for Alcohol Matters. On Thursday 4 April, the report for the first three months of the year will be considered. A large part of the report is devoted to the Grand Bar.

Will insert eight dots

On 27 January this year, an inspection was carried out here by Securitas. The result of this check is that the municipal director considers that it is necessary for the Grand Bar to be given eight points. And that the grant is revoked for a period of one week.

If the politicians choose to follow the municipal director’s recommendation, Grand will have exactly twelve dots, after having been imposed four dots in 2022.

Both the dots and the confiscation are assessed on the basis of the grant regulations. If a license holder is awarded a total of 12 points during a period of two years, the license must be revoked for a period of one week.

Central to both incidents is that “license holders have a duty to ensure that people who need it get the necessary assistance”.

Event 1:

The police wrote in a report after 1 November last year about a person who was too drunk to take care of himself. The police describe it as overindulgence.

– The police received a report about this at 01:53. The reporter was supposed to look after her until an ambulance arrived at the scene, which is between the Grand Hotell and the Campino restaurant, the police write in the report.

As the police had no other mission, they rolled past. By then the ambulance had arrived, and the police saw that the lady was lying on the pavement and was being helped up into a sitting position as far as the Grand Hotell.

Eventually she regains some strength. She herself says that she has only consumed alcohol and that she has been to the Grand Bar.

Event 2:

The pub inspectors write in their report from 27 January this year about an incident which makes the municipal director believe there is reason to react:

– At 02.23 the inspectors became aware of a guest in the bar area. The guest showed clear signs of being under the influence of drugs. The guest was unable to stand upright without support, had swimming eyes and was difficult to make contact with, write the inspectors.

The bar inspectors describe that the guest appeared to be about to fall asleep standing up.

At 02.37 the inspectors observed the person in charge on the spot making contact with the guest. On the way out, the guest had to lean on the person in charge and hold on to the door frame to avoid falling.

– The person in charge showed the guest out of the pub and left the guest on the pavement outside, and then entered the pub, write the inspectors who chose to leave the pub and observe the guest.

It was freezing outside, and the guest is said to have slipped on the ice and leaned against the wall to hold himself up. By chance, a police patrol drove by and the inspectors made contact with them. The inspectors wanted the police to make an assessment of the guest’s condition, as their own assessment was that he was unable to take care of himself.

The police’s assessment must have been that the guest was not able to take care of himself. The police took the person into custody after this.

The inspectors have perceived this incident as a breach of the duty of assistance that catering establishments have. The inspectors write that after the incident, they went back to the Grand Bar and “guided those responsible about the legal requirements regarding the duty to help and how better to handle guests who are obviously under the influence of drugs, but who it is not justifiable to simply expel from the pub without further follow-up. »

This is what the municipal manager writes:

Grand Bar has been given the opportunity to respond, and general manager Bahareh Letnes has responded. This is what the municipal director writes about the sequence of events that makes him believe that the bar should get eight points:

«In their response, it is confirmed that the guest is in the room. Furthermore, the guest is contacted and asked to leave the premises. This agrees with the control report. Grand bar claims in its response that they assumed that the guest was being taken care of as the police were also outside. This is divergent from the inspection report, which clearly describes that the Grand bar expelled the guest, but left the guest to fend for himself in a condition the inspectors found unacceptable. The inspectors contacted the police for assistance.”

As mentioned above, the police have also written a report on a situation that took place in November last year. The municipal director describes this as follows:

«In the police report from November, the situation is described in such a way that it can reasonably be determined that both of these incidents are of the same nature. The duty of assistance has most likely not been complied with in this case as well.”

The municipal director continues:

«The Grand Bar was called to a meeting on 21 March 2024. The purpose of this meeting was to inform the Grand Bar about the possible consequences of the events. They again had an opportunity to submit a description of changes and measures they see necessary to improve their control functions. Authorized security guards have previously been recommended. This was repeated in the meeting. After the meeting, Grand Bar has submitted its proposals for measures and changes.”

– Do not want drunken guests in the bar

The general manager of Grand Bar AS, Bahareh Letnes, writes in her response to the pub inspection that she suspects that the person in question had ingested more than alcohol.

– Shortly after he arrived in the Grand bar, I discovered that he could no longer be in our bar. It is true that I threw the guest out and that he was unable to take care of himself. But right after I threw him out, the controllers go out and talk to him, and I also see the police stop and talk to him. Then I thought that the police would help him, and therefore I did nothing more about this case. writes Bahareh Letnes in the reply.

She says that the Grand Bar has become very strict about letting drunk people in, and that she herself does not want them in the bar, but it is difficult to see who is drugged before they come to the bar. Almost every weekend they have this problem, she says.

She herself says that she does what she can to have a safe city and a safe night club. She says the inspectors think they got drunk at the Grand bar, but that’s not true. She believes that it is unfair that the Grand bar should be punished for letting in people who turn out to be drugged or have problems of some kind.

– I have started to refuse some because I don’t want reports like this again, she writes.

Whether the Grand Bar gets eight points – and loses the grant for a week – will be decided by the control committee for alcohol matters on 4 April.
