The appeal is said to have been dealt with in the wake of a hearing on 24 April. The outcome was reportedly to uphold the sentence.

In a statement from the Premier League, it is stated that Nottingham referred to two mitigating factors in the hearing. The club believes the sale of a high-profile player shortly after the deadline for complying with the financial rules had expired should have been seen as mitigating.

In addition, the club argued that parts of the points draw should have been made conditional. It therefore did not succeed in that.

In March, Nottingham was handed a four-point deduction by an independent commission. The background was a breach of the Premier League’s rules for profitability and sustainability.

The club reportedly could have been deducted six points, but ended up with four as a result of the club acknowledging the affair and co-operating well with the commission in the investigation.

In a statement on its own website, the club wrote that it was “extremely disappointed” by the decision. At the same time, strong criticism was directed at the league management, among other things with reference to the hearing in the case that was carried out last winter.

“We were extremely dismayed at the tone and substance of the Premier League’s argument to the commission,” Forest wrote.

Premier League clubs are allowed under the rules to make a £105m loss over three seasons, but because Forest were in the top division for only one of the years in the period under consideration, their maximum loss was allowed to be just £61m , according to the reports.

The assessment period in question ended with the 2022/23 season.

Acknowledged violations

According to the Premier League, the Forest management will have admitted that they broke the limit of £61 million by as much as £34.5 million.

With two games left in the season, Forest are in the place above the relegation zone. At the same time, Luton are only three points behind. Thus, the club has a knife to its throat.

Everton have also been awarded a total of eight points this season. The Liverpool club still does not risk relegation.

At the same time, Everton has also chosen to appeal the penalty the club has imposed. It is not known whether this will proceed.
