Ruter slows down the hiring of independent consultants – fears breach of rules

Ruter AS recently sent out a message through their procurement portal, with the title:

“Limitations in the possibilities of making offers for sole proprietorships or joint-stock companies/companies where the holder is the sole employee of the company”.

Ruter writes here that “all staffing companies that hire out labor in Norway must (…) be approved in the Labor Inspectorate’s staffing company register”.

It is therefore shown to the new ones the rental ruleswhich many developers have railed against recently, and which has caused a lot of confusion, as they stick sticks in the wheels of independent consultants – including developers who run their own company.

“The offer from the mentioned company forms will be rejected from future competitions, unless the competition basis dictates otherwise,” Ruter writes, adding that “the majority of future assignments” will not be “open to offers” from such independent consultants.

This is apparently at odds with, among other things, statements by former Minister of Business Jan Christian Vestre, who has insisted that independent developers can “continue as before”, according to Digi.

No, but yes

– It is true that last week Ruter AS and Tet Digital AS changed the practice for hiring in existing purchasing arrangements, both for new requests for quotations and as a notification to qualified suppliers, confirms Endre Sundsdal, general manager of Tet Digital, to kode24.

Tet is Ruter’s new IT company, and a department at the latter is responsible for their acquisitions. But it won’t be quite as simple as Ruter now says flat out no to independent developers.

– However, I would like to make it clear that not is correct that we exclude independent consultants from participating in future tender processes. Our decisions will continue to take into account the specific needs of each individual procurement, says Sundsdal.

Among other things, it is about the difference between so-called “contracts” and “hiring of labour”.
