The man in his 40s was sentenced to 60 days’ unconditional imprisonment in the Gulating Court of Appeal just before Easter.

– We agree with the Court of Appeal’s minority that the sentence should be conditional, and not unconditional in view of the long stay, says the man’s defense lawyer Kim Villanger to TV 2.

The prosecution also announces that they are appealing the Court of Appeal’s verdict.

– The public prosecutor objects to the application of the law, says state prosecutor Kristine Herrebrøden to TV 2. The state prosecutor believes that the sharing of images is gross.

In October last year, the man in his 40s was sentenced to a two-month suspended prison sentence in the district court, but the sentence was significantly increased after the prosecution appealed to the Court of Appeal.

In the judgment from the Court of Appeal, it is stated that the man “lifted the sheet aside and took a picture of Sunniva Borgen’s face with his mobile phone. The picture was saved on his mobile phone together with a picture taken from Sunniva Borgen’s Facebook profile.

The funeral consultant was not dismissed from his job, as the prosecution wanted.

A 30-year-old man was sentenced last May to 17 years in prison for the murder of 23-year-old Sunniva Borgen in Åsane on 12 September 2021.
