Verdict, Drink driving | Denied drunk driving – would not say who was driving the car because the lady was married

The man (80) was parked at a roundabout in the center of Skien on the evening of 15 October last year. Coincidentally, two policemen who were off duty drove by. They reacted to the car, which then drove off and ended up on top of two pavements on the road.

The officers called the police operations center as they followed the car, which eventually parked outside the driver’s residence. The policemen saw that the man was alone in the car, and when he stopped they made contact while he was still in the driver’s seat.

The drunk driver then allegedly said that he “was a bit unlucky” with his driving and did not deny having driven. When the police patrol appeared, one of the policemen who stopped him saw that the man was tested and that the measurement revealed that he was drunk.

It turned out that the man had a blood alcohol level of 1.8.

When the man from Grenland recently appeared as a defendant in the district court in Skien, he had a different explanation for what happened in Skien on Sunday evening in October last year.

The man claimed that he had only been a passenger, and that a woman had been driving the car. However, he would not reveal her name because she was married.

The court did not believe the story about the married lady he had to protect.

Lost driver’s license

Just three days after the drive last year, the man was sentenced for a previous drunk driving. At the time, he had around 1.2 in the blood alcohol level and the court believed that his driving was both risky and could lead to traffic accidents. Then, among other things, he had driven in the wrong direction in a roundabout, so that an oncoming car had to steer away.

He then received a 21-day suspended sentence and a NOK 53,000 fine.

The man lost his “tag” after this, and did not have a driver’s license when he was caught again in the center of Skien last year.

The court believes that driving over a roundabout and onto the pavement could easily have led to an accident. He was sentenced to a prison sentence of 30 days, which was a joint sentence with the sentence he received last year.

The 80-year-old has to pay a fine of NOK 53,000 and lost the “note” for the next three years. He must also pay NOK 2,000 in court costs.

The verdict was unanimous.
