Crime and justice: On 7 July last year, the accused policeman in his 30s was acquitted in Buskerud district court. The district court considered that the man’s use of force in an episode at a petrol station in the center of Kongsberg was within what police officers can allow themselves.

The prosecution appealed the verdict – and the case will come before the Borgarting Court of Appeal for four days from Tuesday.

It was on the night of 30 October 2022 that the policeman put Kevin Winness Simensen, who had just been thrown out of a nightclub, to the ground.

He then hit him with a clenched fist, sprayed him with pepper spray and hit him on the head and body with a telescopic baton. Everything was documented on a surveillance camera at the gas station.

In advance, the policeman believed that the situation was about to escalate, and that he perceived Simensen as aggressive.

Now it will be up to the Court of Appeal to decide whether this was a use of force that is within what the police can allow themselves in a dangerous situation.
