Lawsuit, Accident | Man sentenced to prison after fatal boat accident in Lyngdal

The man in his 30s has been sentenced to 60 days in prison, writes Advokatwatch. 39 days are made conditional with a probationary period of two years.

The boat accident happened at 1.30 on the night of Monday 24 July last year outside Korshavn in Lyngdal. It was 37-year-old Stian Alexander Stene Slotte from Bærum who died when the boat with four people on board hit an iron pillar in the bay.

– During his navigation of the boat, according to the conditions on the spot, he was not sufficiently watchful, careful and/or attentive, as he guided the boat in the dark with limited visibility, says the judgment from the Agder district court.

– The family did not want this. If they had been allowed to decide, there would never have been a criminal case, says Henning Harborg, legal counsel for the deceased’s wife, to Budstikka.

The driver was also speeding too fast, and he had also not taken the mandatory boat driving test, according to the judgement.

The man has also been sentenced to a suspension period for taking the boat driving test for two years from the time of the accident. In addition, he must pay court costs of NOK 5,000.

– My client has received the verdict and we will now spend plenty of time reading it. He has taken time to reflect and we must also consider a possible appeal. This case is very tough for him, says defender Nils Anders Grønås to Budstikka.

– I register that the prosecution has received approval for the arguments put forward in the proceedings, and that the verdict is essentially in line with the request for punishment, says police attorney Svein Håland, who was the prosecutor in the trial, to Budstikka.
