(Nettavisen): The woman in her 30s died of her injuries, after she was hit by a car at Haugenstua center in November 2022. The driver, in his 20s, then drove away from the scene.

The driver from Romerike has now been sentenced to 30 days in prison.

Investigations after the accident also showed that he had kept the speed limit of 50 km/h at the scene. The woman was hit after stepping onto the road where there was no pedestrian crossing.

In the district court, the now convicted driver explained that he did not see the woman before he ran over her.

The Oslo District Court believes the driver acted negligently. The road outside Haugenstua center was heavily trafficked by both soft and hard road users at the time of the accident. The court believes that he was therefore traveling at too high a speed than the conditions dictated, and that he did not follow closely enough.

Mitigating

– It has also been proven that the defendant also did not have the concentration linked to the entire complicated traffic picture with possible dangers. He was apparently not aware of the pedestrians walking on the pavement on the left side of the road (…). He said he had not seen them. He explained that he only saw that there was a clear path forward. He then did not take into account that other road users could enter the road, writes the district court in the judgement.

The district court also finds it “proved that the defendant intentionally left the scene after he was aware of personal injury”.

The District Court nevertheless believes that there are significant mitigating circumstances that have an impact on the sentencing.

– It is shown that the negligence in the collision was not gross. The injured party contributed by breaking traffic rules of conduct. The defendant left the scene, but it was after panic and shock. He notified the police after 20 minutes, as soon as he had thought about it. He has pleaded guilty for this relationship from the outset, writes the district court.

Big consequences

The district court also emphasizes that the accident has had major negative consequences for the man. He lost his driving license after the accident, which in turn meant that he lost his job, as well as the opportunity to take a vocational certificate. From being in work, he now receives support from NAV.

He got his driving license back today.

The man’s lawyer, Olle Nohlin, says that the verdict will not be appealed.

– We believe that the district court’s due diligence assessment is too strict and that he should be acquitted of negligence. The verdict will not be appealed, however, as the most important thing for the client was to get his driver’s license back. We managed to achieve that, he says to Nettavisen.
